Halloween is around the corner, scary ghosts and goblins abound. ?While my son does not fear these seasonal monsters, ?he does fear the flu shot. Believe me, he is not the only one.
As a doctor, I have a plea. Please vaccinate yourself and your family against the flu this year.? Just now, a grandparent declined the flu shot here in my office. The flu shot is needed to protect her from the flu, and it is also needed to protect any spread of infection to her grandchildren and her cancer-stricken mother.
For a physician, it is sometimes difficult to comprehend some of the personal medical decisions of our patients.? Please understand, I try to understand your choices as well, but due to my professional training and knowledge, I am very opinionated.
I hate to say it, but the flu shot is what my children call a ?no-brainer?.? It is a killed virus and can NOT give you the flu.? If you get the ?flu? at the time you receive your flu shot, it is because you picked up another bug about the same time.? While I won?t argue with your persistence that your ?flu? is from the flu-shot, I will quietly disagree with your opinion.? I can also refer you to a good resource: http://www.cdc.gov/flu/about/qa/flushot.htm, which will confirm the facts.
Are you still a nonbeliever? Are you concerned about side effects?? The most common side effect is tenderness at the site of the injection.? The soreness from the injection certainly beats the pain and suffering associated with the flu virus.? Trust me; it just takes one time for you to get the flu before you decide to proceed with annual flu vaccination.
Can you still get the flu after the flu shot? ?After receiving the vaccine, it takes about 1-2 weeks for immunity to occur.? Even with full immunity, there are several new unexpected strains of the flu that arrive every year. It is an ever-changing virus and thus the need for annual immunizations.? There are also many flu-like illnesses every winter that are NOT covered by the flu shot.
Contraindications to the flu shot? ?(That is an entirely different blog!) Refer to the cdc.gov web site for full information.? The flu shot is a killed virus and not active, but the coveted intranasal vaccine is an ?altered? live virus and is contraindicated in many conditions where immunity may be low.
What you need to know: If you have young infants (<6months of age), elderly parents (>65 years of age) or anyone with a low immune system (i.e. cancer) or respiratory problems such as asthma, it is YOUR responsibility to protect THEM against the flu.? At my clinic, if we (employees) don?t get the flu shot, we must wear surgical masks in order to protect our patients from our own contagion. Perhaps you should consider the great responsibility you have for family and friends and protect them from the flu by immunizing yourself.

Auctions are not the only permissible method for disposal of natural resources across sectors, the Supreme Court said holding that the 2G verdict was confined to allocation of spectrum and is not applicable to other resources.
Giving its opinion on the Presidential reference arising out of 2G verdict, a five-judge constitution bench headed by Chief Justice S H Kapadia also ruled that common good is the touchstone for any policy and if it meets that then any means adopted is in accordance with the constitutional principles.
Auction despite being a more ?preferable method? of allotment of natural resources cannot be held to be a constitutional mandate, observed the bench also comprising justices D K Jain, J S Khehar, Dipak Misra and Ranjan Gogoi.
?In our opinion, auction despite being a more preferable method of alienation/allotment of natural resources, cannot be held to be a constitutional requirement or limitation for alienation of all natural resources and therefore, every method other than auction cannot be struck down as ultra-vires the constitutional mandate,? the bench said.
The bench said that auctions may be the best way of maximizing revenue but revenue maximisation may not always be the ultimate motive of the policy and natural resources can be allocated to private companies by other methods for the purpose to subserve public good.
?Common good is the sole guiding factor under Article 39(b) for distribution of natural resources. It is the touchstone of testing whether any policy subserves the common good and if it does, irrespective of the means adopted, it is clearly in accordance with the principle enshrined in the Article,? the bench said.
The apex court referred to various judgements delivered by it earlier while upholding government?s decision to allocate natural resources through means other than auction.
?It is manifest that there is no constitutional mandate in favour of auction under Article 14. The Government has repeatedly deviated from the course of auction and this Court has repeatedly upheld such actions,? the bench said.
It said ?whenever the object of policy is anything but revenue maximization, the Executive is seen to adopt methods other than auction?.
Justice Khehar, who wrote a separate but concurring judgement, said that natural resource should not be dissipated as a matter of charity, donation or endowment, for private exploitation.
?No part of the natural resource can be dissipated as a matter of largess, charity, donation or endowment, for private exploitation.
Each bit of natural resource expended must bring back a reciprocal consideration.
The consideration may be in the nature of earning revenue or may be to best subserve the common good. It may well be the amalgam of the two.
?There cannot be a dissipation of material resources free of cost or at a consideration lower than their actual worth. One set of citizens cannot prosper at the cost of another set of citizens, for that would not be fair or reasonable,? Justice Khehar said.
The court disagreed with the contention that auction should be the only means of allocation as other methods can be abused by the private companies in connivance with government authorities as happened in 2G case.
?It may be said that even auction has a potential of abuse, like any other method of allocation, but that cannot be the basis of declaring it as an unconstitutional methodology either. These drawbacks include cauterisation, winners curse etc?.
?However, all the same, auction cannot be called ultra vires for the said reasons and continues to be an attractive and preferred means of disposal of natural resources especially when revenue maximisation is a priority?.
?Therefore, neither auction, nor any other method of disposal can be held ultra vires the Constitution, merely because of a potential abuse,? the bench said.
The court said that revenue maximisation cannot always be the primary consideration while allocating resources to private companies and assume secondary consideration when the development is the main consideration.
?Revenue maximization is not the only way in which the common good can be subserved. Where revenue maximization is the object of a policy, being considered qua that resource at that point of time to be the best way to subserve the common good, auction would be one of the preferable methods, though not the only method?.
?Where revenue maximization is not the object of a policy of distribution, the question of auction would not arise. Revenue considerations may assume secondary consideration to developmental considerations,? the bench said.
It said that the suggestion that disposal of a natural resource for commercial use must be for revenue maximization is based ?neither on law nor on logic?.
?Economic logic establishes that alienation/allocation of natural resources to the highest bidder may not necessarily be the only way to subserve the common good, and at times, may run counter to public good?.
?Hence, it needs little emphasis that disposal of all natural resources through auctions is clearly not a constitutional mandate,? the 208-page opinion given by the apex court said.

Effectiveness of glucose-lowering drugs is the focus of the multi-year research project
WASHINGTON - John Lachin, professor of biostatistics, epidemiology and statistics at the George Washington University, has been awarded a five-year, $134 million grant from the National Institute of Health's National Institute of Diabetes and Digestive and Kidney Diseases to conduct a clinical trial examining the long-term effectiveness of several glucose-lowering medications for treatment of people with type 2 diabetes. The grant sets a record as the largest sum award GW has ever received.
Dr. Lachin, interim director of GW's Biostatistics Center in Rockville, Md., is principal investigator for the grant along with David M. Nathan, M.D., director of the Diabetes Center at the Massachusetts General Hospital and professor of medicine at Harvard Medical School, both in Boston. The pair, working jointly with investigators at GW and Massachusetts General Hospital, recruited a network of more than 40 clinical centers nationwide to participate in the study.
"This funding is tremendously important to healthcare as it could result in more effective treatment of diabetes," said Leo Chalupa, vice president of research at GW. "The award of this grant signifies that the Biostatistics Center is a premier facility of its type and that Dr. Lachin and the project team deserve tremendous credit for putting together this successful investigator-initiated grant application. An award of this magnitude will increase the future ranking of GW among the country's research universities and bring us closer to the goal set by President Knapp of becoming a top tier research institution."
Titled Glycemia Reduction Approaches in Diabetes: A Comparative Effectiveness (GRADE) Study (grant # 1 U01 DK-098246), the clinical trial will directly compare the most commonly used medications to treat type 2 diabetes.
"Type 2 diabetes is an epidemic that threatens to become the century's major public health problem and poses enormous human and economic challenges in the U.S. and worldwide," said Dr. Nathan.
Dr. Nathan is the senior medical and scientific investigator for the project and chairs the GRADE Research Group. The director of the Coordinating Center, Dr. Lachin, is the senior biostatistician for the project and is responsible for the coordination of all study research activities. Together they will provide the scientific leadership for the project and oversee all study activities.
The study will address the challenges of type 2 diabetes in a randomized, clinical trial of 6,000 patients with recent onset of type 2 diabetes. The GRADE study will compare the effects of four glucose-lowering medications - the sulfonylurea glimepiride, DPP-4 inhibitor sitagliptin GLP-1 agonist liraglutide and basal insulin glargine, added to metformin over about four years and track their success in combating the disease. Each of the drugs will be used in combination with metformin, the widely accepted first line medication for treatment of type 2 diabetes.
"For people with type 2 diabetes, this is a compelling need because numerous competing treatments are available," said Dr. Lachin. "While each agent was found to safely and effectively reduce blood glucose for relatively short periods such as six months to a year, type 2 diabetes will usually require continued treatment over a lifetime. GRADE'S primary objective is a direct comparison of the commonly used drugs over a more realistic period of time with regard to glucose-lowering, side-effects, tolerability, other effects and costs."
Glucose management is important in diabetes patients because sustained elevated levels of blood glucose can lead to extensive damage to the circulatory system which then can lead to a host of diabetic complications. Damage to the nerves can lead to amputations of the extremities, particularly feet; damage to the kidneys can lead to end stage renal disease requiring dialysis or transplantation; and damage to the eyes can lead to impaired vision or blindness.
"The goal of therapy should be to maintain a blood glucose level as close to the non-diabetes range as possible to prevent or slow the progression of these complications," said Dr. Lachin. "The principal study objective is to determine which of these therapies most effectively and safely reaches and maintains such near normal levels of blood glucose."
More than 40 participating clinical centers each plan to recruit at least 150 eligible patients who have consented to be randomly assigned to one of the four therapies under study. Funds from the grant to GW will be dispersed to these centers to support their activities in the GRADE study.
GW's Biostatistics Center will coordinate all research and operational activities at all sites for the study.
The initial steps of the project are to begin Oct. 1. The present grant supports the first five years of the project, with the opportunity for renewal for an additional three years. The total project duration is scheduled to be eight years.

The main difference is the costs are normally much higher for a commercial deal due to the additional research required in not only closing on the physical property but the financial aspects as well.
It is normal for commercial real estate closing costs, even for an inexpensive property, to run into the thousands of dollars. As a buyer you need to be aware of these costs and factor them into your overall price for obtaining the property.
All of the closing costs are negotiable between the seller and buyer. As a buyer you can, and should, have it stated in the contract which party will be responsible for each cost at closing such as title insurance, deed stamps, surveys and settlement fees just to name a few. However, since RESPA (Real Estate Settlement and Procedures Act) does not apply to properties that have more than 4 residential units, your lender is not restricted in what they can collect from you at closing.
For example, in a residential closing the lender can only collect a certain amount of money to hold in escrow for expenses like real estate taxes and insurance. In a commercial real estate transaction there is no limitation and your lender could require you to put significantly more money into escrow or charge higher loan administration fees, points or any other cost they deem acceptable. Because of this it is critical you negotiate all of the fees for your loan with your lender well in advance of closing.
While there is nothing stopping you from closing a commercial real estate transaction on your own, it is highly recommended you use the services of a qualified real estate attorney. Although this presents an added expense at closing that can run anywhere from $1,000 to $5,000 or more depending on the size and complexity of the deal, it is money well spent. A mistake made at the closing table can cost you untold tens of thousands of dollars over your entire length of ownership of the property.
With all of this in mind, here is a basic breakdown of what you can expect each party to pay for in a commercial real estate closing.
Seller Paid Expenses Title Policy covering the basic insurance requirements but if your lender requires specific endorsements to the title policy then the buyer can expect to pay for those endorsements.

The planned road reconstruction, still a month from being voted on by the New Mexico Transportation Commission, has cast renewed attention on WIPP. But that project is nothing compared to the ideas of Carlsbad-area politicians, who want to build their region?s employment base by establishing even deeper ties to the nuclear-disposal industry.
?WIPP is one of the greatest unsung success stories around, a project with a perfect safety record and more of a game changer for our economy than even oil and gas,? said Eddy County Commissioner Jack Volpato, a Republican. ?I see it or maybe something else like it creating a whole new generation of jobs.?
In particular, Volpato said, Carlsbad and Eddy County will push for a federal study to determine if a second repository similar to WIPP could safely bury high-level nuclear waste from defense projects.
Such an endeavor would maintain or add well-paying jobs in the Carlsbad area. It also would solve an environmental problem for the country, Volpato said.
The idea of taking nuclear waste from the rest of America and salting it away under the desert is not radical thinking in Carlsbad, which has been a neighbor to WIPP since 1999. For many people, nuclear-waste disposal is pure business now, not a cause for worry.
?I was a skeptic when WIPP came here. Then I educated myself and I have become entirely comfortable with it,? Volpato said.
The county commissioners and the Carlsbad City Council recently voted to hire a Washington lobbying firm at a cost of $15,000 a month to pursue more business opportunities in radioactive disposal, said City Administrator Jon Tully.
Two commissioners and two council members dissented, but the area is moving ahead to market itself as a safe place to deposit nuclear waste.
Tully said the duties of the lobbying company, the C2 Group, would be narrowly focused on nuclear research and projects that could create jobs for Carlsbad.
These could include interim storage of certain wastes, expansion of WIPP?s mission in burying transuranic waste and perhaps other undertakings to help in nuclear clean-ups. ?
Under the federal law that created WIPP, the repository can only accept transuranic waste from government sites that had a defense mission. These included operations in eight states, notably Los Alamos in New Mexico, Rocky Flats in Colorado and the Savannah River site in South Carolina.
Last year, U.S. Rep. Steve Pearce introduced a bill to expand WIPP?s mission, saying about 200 good jobs would be in jeopardy if nothing was changed.
Pearce proposed that WIPP be allowed to accept government-owned transuranic waste not related to defense missions. One example of this is the West Valley site south of Buffalo, N.Y. It was a commercial venture used as a nuclear fuel reprocessing center.
Just like the ongoing shipments from defense sites, this waste could be trucked to WIPP and deposited in ancient salt beds 2,150 feet below the earth's surface.
Volpato said such concepts for sustaining WIPP while cleaning up environmental messes remain possible. But the area?s lobbying effort also could seek other types of business, perhaps eventually the high-level nuclear waste from defense operations.
?People seem to have heard of Yucca Mountain but not about us,? Volpato said of the defunded Nevada repository.
The oncoming nuclear campaign by Carlsbad and Eddy County probably will re-ignite opponents of WIPP, Volpato said. His bet is that most people can be won over, provided that the scientific research shows a new nuclear mission can be handled as safely and efficiently as WIPP has been.
As for the state highway project, Tully said city officials still had questions about the plan but expect to resolve them in meetings with the New Mexico Department of Transportation.
Gary Shubert, the engineer for NMDOT?s division in southeastern New Mexico, said the state needs to improve the base of New Mexico 200, a designated WIPP route. Shubert described it as a two-lane road with the peaks and valleys of a roller coaster.
The state proposes to close a portion of it next year. That means an estimated 560 transuranic waste shipments to WIPP would take an alternate route in the Carlsbad area.
Trucks would depart from U.S. 285 southbound at New Mexico 524. Then they would go east to Canyon Street before continuing onto U.S. 62/180.
Shubert said this route is about a half-mile longer than the existing path to WIPP.

Act, at the University Center at 525 South State Street in downtown Chicago.
Conferees at the AMI conference in Chicago are hearing from monetary theorists, economists, advocates and professors as they discuss the moral approach at the heart of successful monetary reform.
With its introduction one year ago by Congressman Kucinich the NEED Act?s paradigm-shifting legislation has broken new ground, formally advancing a simple but powerful idea: that the creation of wealth should be in the hands of the people, and used not for the benefit of financial speculators.
In the last year, the NEED Act has received endorsements from the International Association of Machinists and Aerospace Workers (Chicago area Local 126) Executive Board, the Chicago?s Teacher?s Union and the Northeast Ohio American Friends Service Committee.

Professor Yamaguchi?s analysis showed that present policies cannot work. Attempts to reduce deficits by either spending cuts or tax hikes plunges the economy into deeper recession, reduces revenues, and ends up increasing deficits. An International Monetary Fund Modeler also studied the NEED Act. He concluded that direct governmental control of the money supply could significantly reduce business cycles, and would eliminate bank runs, lead to large reductions in the levels of both government and private debt, and generate large steady state output gains due to the removal or reduction of interest rate risk spreads, taxes, and bank costs, and zero steady state inflation.
?The NEED Act is so named because America has a jobs emergency and a monetary policy emergency. Congress has not stood up and reasserted its Constitutional control over the monetary system. Instead, our nation?s ability to create money was farmed out to the Federal Reserve in 1913. The ?Fed? is an institution which operates with virtually no oversight from Congress. Its primary function has been to assist private financial institutions, many of which are multinational,? said Kucinich.
?The NEED Act places the Federal Reserve under the authority of the Treasury. It creates verifiable transparency in our nation?s monetary policy choices. It will put our nation?s resources to work for the American people. The NEED Act would put 7 million Americans back to work rebuilding our nation?s infrastructure without debt or inflation,? Kucinich concluded.
